Terms of Service

Charm is a paid membership that lets people promote products through a partner page and affiliate links. Charm and our third-party shops handle inventory, shipping, and customer service. You promote. We handle the rest after the click.

Eligibility

You must be at least 18 years old and able to form a contract. You are responsible for the accuracy of the information you give us and for activity on your account.

Membership

Standard is $89 per month. Premium is $199 per month. Membership includes access to a partner page, affiliate links, promotional products as described at signup, and the right to earn commissions while the membership is active. Premium includes more features and a wider set of promotional products.

Your membership stays active as long as you keep paying. Fees are billed in advance. If a payment fails, Charm may contact you to resolve the issue (for example, an expired card) so your membership can continue.

If you leave Charm or request to close your account, your partner page, links, and ability to earn commissions end. Commissions and potential payouts do not pause for a later return. Depending on the situation, Charm may, at its discretion, send a partial payment for amounts that were already open at the time of closure. When your account is closed, account data associated with that membership is removed. If you join again later, you start fresh and cannot resume ranks, history, team structure, or other progress from the closed account.

No refunds on membership

Membership fees are not refundable. That includes the current billing period if you cancel, close your account, or stop using Charm. You may keep access through the end of the period you already paid for, unless we end the membership for a terms violation. Unused time, unused features, and promotional products included with membership do not create a refund. Cancellation stops future charges. It does not refund fees already paid. The only exception is where the law requires a refund.

Product purchases made through partner links are handled by the selling shop under that shop’s return policy. Those product returns are not membership refunds and do not entitle you to a refund of Charm membership fees.

How you earn

While your membership is active, you may earn 20% of eligible consumer product sales through your links; $50 when someone you invite joins as a Charm Partner (up to 5 people); and 10% on eligible product sales from two levels of your team, as described on the site. We do not require you to recruit or refer members. Referring others is optional. Earnings are not guaranteed. They depend on actual eligible product purchases through your links, your personal purchases when those count under the program, and the program rules in effect at the time of the sale.

We may withhold, reverse, or adjust commissions for returns, fraud, chargebacks, policy violations, or tracking errors. Payouts are made according to the method and schedule we provide when you join. Charm and Stripe may require additional verification details from Charm members before or while payouts are processed. If required information is missing or incomplete, payouts may be delayed or paused until it is provided.

Independent contractor status

Charm Partners are independent sales contractors. You are not a Charm employee, and you are not a franchise owner. Nothing in these terms creates an employment, partnership, joint venture, or franchise relationship between you and Charm.

You are not treated as an employee for your services or for state or federal tax purposes. You are responsible for paying all local, state, and federal taxes that apply to amounts you earn through Charm. Charm will provide 1099 or other tax forms to Partners when we are required by law to do so.

You have no authority to bind Charm to any obligation, contract, or commitment. You may not present yourself as an employee, agent, or representative of Charm with power to act on Charm’s behalf.

Code of conduct

As a Charm Partner, you agree to uphold a professional standard on the social media accounts and channels you use to promote Charm’s services or products. Charm asks Partners to uphold honest and inspirational values and to act as good members of society in how they show up online and offline. You must not make insulting, slanderous, racist, or discriminatory statements based on identity, religion, gender, sexuality, political affiliation, or similar characteristics. Charm may investigate reported violations and may suspend or dismiss your membership if we find that you have broken this code of conduct.

Your responsibilities

You must promote products honestly. Do not make false claims about products, income, or Charm. Do not guarantee earnings, promise specific income results, or present Charm as a get-rich-quick opportunity when you post, recruit, or talk about the program. Follow advertising, endorsement, and disclosure rules that apply to you, including making it clear when you may earn from a link. Do not spam, scrape the site, or interfere with other Partners. You are responsible for your own taxes, as described above.

Our role

Charm provides membership access, partner tools, affiliate tracking, and commission eligibility. Membership is not a franchise, a business opportunity with guaranteed results, or a promise of income. Earnings depend on actual eligible product purchases through your links, your personal purchases when those count under the program, and activity under the program rules in effect at the time.

Charm is not the manufacturer or retailer of every product shown. Product availability, pricing, and fulfillment may change. Third-party shops are responsible for the goods they sell, including quality, defects, shipping, and customer service under their own terms. Charm is not liable for shop performance beyond what we expressly agree to handle.

Content you create or post while promoting Charm is yours. Charm does not control your social accounts and is not responsible for your statements, claims, or conduct. Charm does not endorse every Partner post or representation.

Intellectual property

Charm’s name, site, and materials belong to us. You may use them only to participate in the program. You keep rights to content you create, and you grant Charm a license to use it to operate and promote the service. You may not misrepresent or defame Charm. Doing so can result in your account being banned.

By joining or promoting Charm, you grant Charm a perpetual, royalty-free, worldwide right to use your quotes, reviews, testimonials, photos, videos, captions, and other promotional materials you create or share about Charm, our products, or your experience as a Partner, for marketing and promotional purposes in any medium. Charm does not owe you compensation for that use. This right continues after you leave Charm, cancel membership, or close your account.

Indemnification

You agree to defend, indemnify, and hold harmless Charm and its officers, directors, employees, and agents from and against claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your promotions, posts, statements, or other conduct; your misuse of Charm or the program; your breach of these terms; or your violation of any law or third-party right.

Termination

You may stop using Charm and request account closure at any time. We may suspend or end access if you break these terms, if we have to for legal reasons, or if we discontinue the service. When membership ends or the account is closed, access to your page and links stops, and the account data is gone as described above. Charm may, at its discretion, issue a partial payout for open amounts depending on the situation. Returning later means a new membership, not a continuation of the old one.

If you create a social media page, profile, group, community, or similar account specifically to promote Charm, Charm products, or your Charm Partner services, you must delete that account when you leave Charm or your membership ends. Renaming it, changing the username or handle, or converting it to another purpose is not enough. The account must be deleted.

Disclaimers and limits

The site and membership are provided “as is.” We do not warrant uninterrupted service or specific income. To the fullest extent the law allows, Charm is not liable for indirect, incidental, or consequential damages, or for amounts above the membership fees you paid us in the three months before a claim.

Arbitration and class-action waiver

By signing up as a Charm Partner or using the membership, you agree that any dispute arising out of or relating to these terms, Charm, or the program will be resolved by binding individual arbitration, not in court, except where the law does not allow that requirement. You also waive any right to start, join, or participate in a class action, collective action, or other representative proceeding against Charm. Claims may be brought only in your individual capacity.

Changes

We may update these terms and the commission structure. Material changes will be posted on this page. Continued use after a change means you accept the new terms.
